These Terms of Service ("Terms") explain how you may use OK.secure and what you can expect from us. They apply to all users of the OK.secure application and related services ("Services").

By accessing or using OK.secure, you confirm that you have read, understood, and agreed to these Terms and the OK.secure Privacy Policy.

If you do not agree, you must not use the Services.

1. Who We Are

OK.de Services GmbH ("OK.secure", "we", "us") provides the technical platform, interfaces, and software described in these Terms.

2. Scope of These Terms

2.1 Services Covered by These Terms

These Terms apply to your use of:

  • OK.secure Messenger
    Encrypted one-to-one and group messaging, including text, file sharing, audio calls, and video calls.
  • Non-custodial crypto wallet
    A self-custody wallet that allows you to manage crypto assets under your exclusive control.
  • OK.pay branded financial interface
    A technical interface that enables access to regulated financial services provided by third parties.
  • Optional AI-assisted features (OK.ai)
    Automated tools that generate responses using third-party AI systems.

2.2 Services Not Covered by These Terms

Certain services accessible through OK.secure are provided by independent third parties, including:

  • Cryptocurrency exchanges and on-/off-ramps
  • Crypto-to-crypto exchange services
  • Banking, payment, and card-issuing institutions

These services are governed by separate agreements between you and the respective providers. OK.secure is not a party to those agreements.

3. Minimum Age and Eligibility

3.1 General Minimum Age

You must be at least 16 years old to use OK.secure.

OK.secure does not knowingly permit use by persons under 16.

3.2 Financial and Crypto Services Age Requirement

Use of certain Services, including:

  • the non-custodial crypto wallet, and
  • OK.pay financial services, including any Visa debit card

may require that you are at least 18 years old, depending on applicable law and the requirements of third-party service providers.

OK.secure does not determine eligibility for regulated financial services.

4. Your Account and Security

4.1 Account Responsibility

You are responsible for:

  • Providing accurate and up-to-date account information
  • Securing your device and login credentials
  • Preventing unauthorized access to your account

OK.secure cannot control how your device is used and relies on you to protect access.

4.2 Crypto Wallet Responsibility (Important)

If you use the crypto wallet:

  • Your private keys and recovery phrase remain exclusively under your control
  • OK.secure does not store, back up, or recover them
  • Loss of keys or recovery phrase results in permanent loss of access to crypto assets

This is an inherent characteristic of non-custodial wallets.

5. Acceptable Use

5.1 Lawful and Responsible Use

You may use OK.secure only for lawful purposes.

You must not:

  • Use the Services for illegal activities
  • Circumvent security or safeguards
  • Disrupt the platform or other users

We may take action where required by law or necessary to protect users or service integrity.

5.2 Your Content, Communications, and Actions

You are responsible for:

  • Messages you send
  • Files you share
  • Calls you initiate or join
  • Actions you take using the Services

This responsibility includes content shared in group chats, group calls, and any recordings, screenshots, or copies made by users.

OK.secure does not pre-review content but may act where legally required.

6. AI-Assisted Features (OK.ai)

6.1 Nature of AI Features

AI features generate automated responses using third-party AI services.

AI-generated content:

  • Is produced automatically
  • May be inaccurate, incomplete, or outdated
  • Is not reviewed by humans

AI features are intended as assistance only.

6.2 AI Compliance, Processing, and Safeguards

AI features are designed as assistive, non-autonomous systems.

  • AI systems do not make binding decisions
  • AI outputs do not have legal or financial effect
  • AI features do not perform profiling or automated decision-making within the meaning of Article 22 GDPR

Appropriate technical and organizational measures are implemented to ensure lawful and secure processing.

6.3 No Responsibility for AI Output

OK.secure:

  • Does not guarantee the accuracy or suitability of AI-generated content
  • Is not responsible for decisions made based on AI output
  • Does not provide professional advice (legal, financial, medical, or otherwise)

To the maximum extent permitted by law, OK.secure disclaims all liability arising from or related to AI-generated content.

7. Crypto Wallet Services

7.1 Non-Custodial Wallet Model

The OK.secure wallet is non-custodial, meaning:

  • You control your crypto assets directly
  • OK.secure never holds or manages funds
  • Blockchain transactions are irreversible once confirmed

You acknowledge the risks associated with blockchain-based systems, including volatility and potential loss of value.

7.2 No Regulated Crypto-Asset Services Provided by OK.secure

OK.secure does not itself provide regulated crypto-asset services such as custody, exchange, brokerage, or execution of transactions, and does not act as a crypto-asset service provider.

All regulated crypto-asset services are provided exclusively by independent third-party providers.

7.3 Public Blockchain Information

Blockchain networks are public by design.

Wallet addresses, transaction data, and balances may be visible to third parties.

OK.secure does not control blockchain networks or explorers.

8. Third-Party Crypto Services

Crypto activities such as buying, selling, exchanging, or spending crypto are provided by independent third-party providers, including:

  • Coinify
  • OnRamper
  • Changelly
  • Bitrefill

These providers operate under their own terms and may require identity verification (KYC).

OK.secure does not control their services or decisions.

9. OK.pay Financial Services

9.1 Nature of OK.pay

OK.pay is a financial service product provided by Prisma Payments EP S.A. and its regulated partners.

OK.secure provides only the technical access interface enabling you to connect to those services.

The OK.pay interface itself does not provide regulated financial services.

9.2 No Financial, Banking, or Fiduciary Role

OK.secure is not:

  • A bank
  • A payment service provider
  • An electronic money institution
  • A card issuer
  • A financial advisor, trustee, or fiduciary

OK.secure does not hold funds, execute transactions, or owe fiduciary duties to users.

9.3 Separate Cardholder and Financial Agreements (Important)

Use of OK.pay financial services, including any Visa debit card, is subject to separate agreements between you and:

  • Prisma Payments EP S.A.
  • Issuing banks
  • Payment networks (e.g. Visa)

Those agreements govern card usage, fees, limits, disputes, and compliance obligations.

In case of conflict, issuer or cardholder agreements prevail over these Terms.

9.4 Financial Provider Decision Authority

All decisions regarding account approval, card issuance, transaction authorization, suspension, or termination are made exclusively by the relevant financial service providers, not by OK.secure.

9.5 No Guarantee of Availability or Acceptance

OK.secure does not guarantee continuous availability, acceptance of the Visa debit card, or successful authorization of transactions.

9.6 Platform-Level Financial Rules (Clarification)

Certain platform-level rules applicable to financial services are governed by agreements between Prisma Payments EP S.A. and its financial service partners and are not part of these Terms.

10. Memberships, Subscriptions, and Fees

10.1 Free and Paid Features

OK.secure may offer both free and paid features.

Paid features may include subscription-based memberships or add-on services.

10.2 Subscription Terms

Subscriptions renew automatically unless cancelled in accordance with the applicable purchase platform.

Billing cycles, pricing, and applicable taxes (including VAT) are disclosed prior to purchase.

10.3 Refunds

Fees are non-refundable except where required by applicable law.

10.4 Third-Party Fees

Fees charged by third-party crypto or financial providers are set and collected by those providers.

OK.secure does not control or refund such fees.

11. Intellectual Property

OK.secure software, interfaces, content, and branding are protected by intellectual property laws.

You may not copy, modify, reverse engineer, or misuse the Services except as expressly permitted.

12. Availability, Confidentiality Limits, and Emergency Use

We aim to keep OK.secure reliable, but:

  • Features may change or be discontinued
  • Temporary interruptions may occur
  • Message delivery, call connectivity, or service continuity is not guaranteed

End-to-end encryption does not prevent recipients from copying, recording, forwarding, or otherwise sharing content they receive.

OK.secure is not intended for emergency communications and does not provide emergency or priority calling services.

13. Account Inactivity and Termination

If your account remains inactive for an extended period, OK.secure may restrict access or delete data in accordance with applicable law and the Privacy Policy.

14. Limitation of Liability

To the maximum extent permitted by law, OK.secure is not liable for:

  • Lost crypto assets or credentials
  • Blockchain network failures
  • Third-party service actions
  • Financial service denials
  • AI-generated content
  • User behavior in chats, group chats, or calls

Mandatory consumer rights remain unaffected.

15. General Disclaimer

Except where prohibited by law, the Services are provided "as is" and "as available", without warranties of any kind.

16. Platform Integrity and Enforcement

OK.secure may suspend, restrict, or terminate access to the Services where required by law, financial regulations, card-scheme rules, or partner instructions.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

To the extent permitted by law, the courts of Berlin, Germany shall have jurisdiction. Mandatory consumer protection laws remain unaffected.

18. Notices and Communications

Legal notices relating to these Terms must be sent to:

OK.secure may provide notices to users via the app or other reasonable means.

19. Changes to These Terms

We may update these Terms to reflect service, legal, or regulatory changes.

Material changes will be communicated. Continued use constitutes acceptance.
